Planning Commission Meeting

Chairman Bill Krucke called the Planning Commission Meeting to order at 7:00pm. Eric Meyer led the group in prayer and afterwards the Pledge of Allegiance was recited. Commissioners who were in Attendance were the following: Bill Krucke, , Ed Amerman, and Eric Meyer. Andrea Pietras represented Charleston County.
Charleston County Representative, Andrea Pietras presented handouts of the revised Plan Development draft. Andrea also provided a copy of Ordinance 2005-3 passed by the South Carolina General Assembly on Vested Rights.
Accessory Structures
The handouts provided by Charleston County Rep Andrea Pieitras at the May 19 meeting titled Accessory Structures were reviewed and discussed at the May 26 meeting. The Planning Commissioners decided that only one change was needed. Under 6.6 Accessory Structures, item B – 1, the statement saying that “an accessory structure shall be located on the rear 2/3 of the lot or behind the principal structure” was deleted from the document.
Cluster Development
The Commissioners decided to accept the requirements indicated on the handouts.
Plan Development
A updated copy of the Plan Development requirements were given out with all of the corrections recommended by the Commissioners at the May 19 meeting.
Vested Rights (Ordinance 2005-3)
Local governments will be required to adopt certain amendments to their land development ordinances. Vested Rights (Ordinance 2005-3) states that developers who are given approval on a plan development or rezoning have two years to proceed with the development plan. At that time he may ask for an extension of one year. He will be allowed a total of five extensions with a time frame of one year for each extension. This allows a total of seven years for a developer to proceed with an approved Plan Development. Procedures will need to be set up by local governments and the developers will need to comply when applying for extensions. Legal questions on Vested Rights will be addressed to Attorney Dennis Rhoad at next meeting. See attached draft copy of Ordinance 2005-3 for detail information of procedures.
A tentative date of June 16 was recommended for a workshop between Town Council and the Planning Commissioners. The Town Council will be provided a finalized copy of all recommendations for zoning and densities for review prior to the workshop meeting. After approval, the Town Council will schedule a meeting for a public hearing to present the recommendations.
Eric Meyer made motion for the meeting to adjourn and the motion was second by Ed Amerson. Meeting ended at 7:50PM.
